The votes at the Supreme Court session on former President Luiz Inácio Lula da Silva’s habeas corpus petition currently stands at 5–1 unfavorable to the granting of Lula’s counsel’s request.

Up to 8:40pm, Court Justices Edson Fachin, Luís Roberto Barroso, Alexandre de Moraes, Rosa Weber and Luiz Fux had cast their ballot opposing the former leader’s habeas corpus. Justice Gilmar Mendes was the only one favoring the request.

Six justices are still to vote, including Cármen Lúcia herself. The sitting is expected to last into the wee hours of the night.

The discussion on the case was resumed today after it was first brought to trial on March 22.  The former leader was granted a safe-conduct and waited for today’s ruling at liberty. Lula was convicted by Federal Judge Sérgio Moro to nine years and six months in prison and by the Federal Regional Court of the Fourth Region (TRF4), which increased the sentence to 12 years and one month in the case surrounding the triplex apartment in coastal Guarujá, São Paulo, conducted under Operation Car Wash.
